Release from Liability

The undersigned has enrolled or participated in an online educational program offered by Esoteric Fine Auto Finishing, LLC, an Ohio limited liability company, through its Elite Detailer Academy “Esoteric”). The program presents information, ideas and demonstrations related to automobile detailing services.

By enrolling or participating in the program, the undersigned expressly waives and releases any and all claims, now known or hereafter known, against Esoteric, and its owners, officers, directors, managers, employees, and instructors, and their heirs, successors and assigns (“Releasees”), on account of any injury, death or property damage arising out of or attributable to his/her engaging in any activity similar to those depicted or described in the program. Without limiting the generality of the foregoing, this release specifically includes damage to his/her vehicle and personal injury when attempting to paint correct or coat their vehicle(s) based on information presented in the program. The undersigned covenants not to bring any such claim against any Releasee, and forever releases and discharges all Releasees from liability under such claims.

Further, the undersigned shall defend, indemnify and hold all Releasees harmless against any and all losses, damages, liabilities and claims and expenses of any kind, including attorney fees, incurred by Releasees, arising out of or resulting from any claim of a third party related to the undersigned’s engagement in such activities. This Release constitutes the entire agreement between the undersigned and Releasees regarding its subject matter. It is binding on and inures to benefit of the parties, their heirs, successors and assigns. It will be governed by the laws of the State of Ohio in all respects.
